1.) Agreement to Terms: It is assumed purchaser agrees and accepts these Terms and Conditions of Sales by entering into a business arrangement to purchase product from ATOMIC SPEEDWARE (ATOMIC).

2.) Orders: No order will be considered valid until that order ships from ATOMIC’s facility and an invoice is issued. The minimum order on custom pistons is four. Shelf-stock components may be purchased singularly.

3.) Sales Policy: All orders will be priced according to ATOMIC’s current retail price schedule. A discount will be extended to all qualifying jobbers, dealers or warehouse distributors. A completed dealer/jobber application, copy of business license or other proof (i.e. phone directory listing) must be received before discounts are extended. ATOMIC reserves the right to change prices without notification, although every attempt will be made to notify in advance.

4.) Payment Options: ATOMIC accepts Credit Cards (Visa, Master Card, American Express and Discover), Cashiers Check, Postal Money Order, Bank Wire Transfer and PayPal. Company checks will be accepted once requirements are met after initial order. Personal checks will be accepted, although a five to seven day hold will be put on order processing until funds are cleared. Qualifying accounts are eligible for credit terms; consult your ATOMIC sales associate. All custom piston orders require 100% payment in full prior to order processing. International orders (outside Continental U.S.) require 100% prepayment (See International Sales Policies).
Please note: If an account must be placed into collection, the purchaser will be responsible for all related professional recovery fees.

5.) Sales Tax: Non-refundable sales tax will be charged on all invoices to California purchasers unless a resale card is on file with ATOMIC at time of invoicing.

6.) Shipping (48 continental states): All orders will be shipped by the fastest and/or most economical method of United Parcel Service (UPS) or United States Postal Service (USPS). All shipping charges applied to ATOMIC orders include insurance. All shipments are F.O.B. Moorpark, California, unless drop-shipped from ATOMIC’s suppliers. Drop-ship service is available from ATOMIC’s facilities at $5.00 per shipment. See International Sales Policies for more information.
Any damage due to shipping must be referred directly to the carrier service. ATOMIC cannot be responsible for damages due to carriers' negligence.
Any discrepancies in ATOMIC’s order processing or shipment, such as quantity of parts invoiced versus actual parts delivered, must be reported within 10 days of receipt by customer in order to make a legitimate claim of error.

7.) Warranty Disclaimer: Due to the nature of high performance applications, ATOMIC products are sold without any express or implied warranty of merchantability or fitness for a particular purpose. ATOMIC SPEEDWARE or its suppliers shall not, under any circumstances, be liable for any special, consequential or incidental damages, including, but not limited to, loss of profits or revenue, loss of other property or equipment, cost of purchased or replacement goods, or claims of customers of the purchaser, which may arise and/or result from the sale, installation or use of these parts. Installation of these parts could adversely affect the vehicle manufacturer's warranty coverage. Subject to applicable state law, some items may not be legal for use in California on pollution-controlled vehicles. The purchaser and/or customer is responsible for checking state and federal emission regulations.

8.) Revisions: ATOMIC SPEEDWARE reserves the right to make changes in design, specifications, materials and/or pricing of its products without incurring liability or obligation with respect to similar products previously manufactured or sold.
